This Privacy Statement applies to our websites ("Sites") and mobile apps ("Apps") that link to this Privacy Statement, including 黑料专区 Children鈥檚 Health, , the , and the , as well as aout offline services, (collectively the 鈥淪ervices鈥).

This Privacy Statement explains our practices regarding 鈥淧ersonal Data,鈥 meaning information linked or reasonably linkable to an identified or identifiable individual.

This Privacy Statement does not apply to protected health information regulated by the Health Insurance Portability and Accountability Act (HIPAA). To understand how we may use and disclose protected health information, please review our Notice of Privacy Practices.

1. Personal Data We Collect

Categories of Personal Data we collect include:

  • Contact information (such as name, email address, and phone number).
  • Demographic data (such as age, ethnicity, or gender). Certain types of demographic data may be sensitive under applicable privacy laws (such as racial or ethnic origin).
  • Transaction information (such as associated with donations or purchases, including payment information and transaction history).
  • Community and event information (such as in relation to our community events and classes, including events attended).
  • Online interactions (such as interactions with the Services, IP address or device ID, browsing history; clickstream data; browser and operating system type; date/time stamps; Internet service provider; and approximate geolocation). This may include precise geolocation, which may be considered sensitive under applicable privacy laws.
  • Customer service information (such as customer service chat transcripts or recorded audio).
  • Survey information (such as feedback or responses to voluntary surveys, including health topics you are interested in). Certain types of survey information may be sensitive under applicable privacy laws (such as data revealing your mental or physical health condition or diagnosis).
  • Information about minors under the age of 18 (such as when a parent or guardian provides information about their child or where the minor interacts with us directly). Personal Data about a child under the age of 13 may be sensitive under applicable privacy laws.
  • Government identifiers (such as social security number or driver鈥檚 license; for example, to authenticate identity or to conduct background checks when you apply for a job or volunteer opportunity).
  • Professional or employment-related information (such as where you interact with us as a healthcare provider, including your employer, certifications, and education).
  • Job or volunteer application information (such as resume, experience background, and references). Certain types of this category of Personal Data may be considered sensitive under applicable privacy laws (such as racial or ethnic origin, religious beliefs, mental or physical health condition or diagnosis, sexual orientation, status as transgender or nonbinary, citizenship status, or immigration status).

To the extent that Personal Data is considered sensitive by applicable privacy laws, we obtain consent as required by applicable law.

Depending on your device鈥檚 App permission settings, the App may have access to information related to the following features on your device: Phone Calls (to be able to make calls); Photos/Media/Files Storage (to allow media uploads); Camera (to allow photo capture or video calls); Microphone (to enable audio on calls); Location (may include precise or approximate location). By changing your App permission settings, you may affect your ability to access or use certain features on the App.

2. Cookies and Similar Technologies

We use cookies, pixels, beacons, APIs, SDKs, and other similar technologies (鈥Cookies鈥) on different portions of the Sites. We may use Cookies for different purposes, such as for various performance purposes (such as to load the Sites faster), to enable certain features to work on the Sites (such as video media players), for analytics (such as to measure how visitors use the Sites), and for targeted advertising. What kind of Cookies are enabled on the Sites depends on the Site and the web page.

These Cookies collect information about your online interactions over time and across the Internet, including IP address, device identifiers, pages viewed, clicks, and approximate or precise geolocation (to enable location features, such as to help you find our physical locations).

We may implement data modification and obfuscation tools provided by technology vendors to help us limit how certain information may be collected through Cookies. These tools function as an intermediary between the Sites and Cookies, and allow us to adjust how Cookies interact with the Sites.

You may be able to manage certain Cookies by adjusting your browser or device settings. Note that the Sites do not respond to browser Do-Not-Track signals. For any choices you make regarding cookies, you will have to exercise these choices per website, application, browser, or device. We are not responsible for the opt out or settings tools provided by third parties, including their functionality.

3. Purpose of Processing Personal Data

We may collect and use Personal Data in the following ways, depending on the Service, including to:

  • Support and maintain the Services, including improving its features through analytics and providing you services that you request
  • Facilitate payments, donations, and fundraising
  • Communicate with you, support customer service, and send you transactional or promotional messages
  • Market our services and provide educational materials, including beneficial public health information
  • Determine eligibility of and process job and volunteer applicants
  • Maintain our business relationships, including with healthcare providers
  • Conduct internal operations, including, but not limited to, quality control, quality improvement, training
  • Support research and educational efforts, including through surveys, such as our community events and classes
  • Prevent a serious threat to health or safety
  • Protect our and other鈥檚 interests, including in relation to security and fraud prevention, as well as comply with law and regulations, including responding to and communicating with law enforcement, responding to a court order or other legal process, and participating in judicial process related to lawsuits and disputes.

4. Disclosure of Personal Data

We disclose the categories of Personal Data for the purposes above to other parties, including as directed by you. The categories of recipients of Personal Data include:

  • Affiliates. We may disclose Personal Data to our business units, subsidiaries, joint ventures, brands, or other companies under our common control.
  • Vendors. We use vendors to perform actions or services that benefit us, to provide services to you, or for other actions on our behalf. This includes technical, security, webhost, business operations, and marketing vendors. We do not disclose Personal Data obtained for text messaging purposes (e.g., mobile phone number) with vendors for those vendors鈥 own marketing purposes.
  • Other nonprofits. We may disclose Personal Data to other nonprofit organizations as part of research or educational partnerships or programs.
  • Compliance and legal entities. We may disclose Personal Data to government entities and agencies, regulators, law enforcement, and other parties to comply with applicable laws and regulations, to respond to a subpoena or search warrant or pursuant to legal process, to establish or exercise our legal rights, for fraud or crime-prevention purposes, or for the protection of the rights, property, or safety of our company or third parties. We may also disclose Personal Data in relation to a known or suspected violation of our terms and conditions, fraud prevention, or other unlawful use, including with entities assisting us with an investigation, or as may be required by applicable law.
  • Entities as part of a business transaction. Subject to applicable law, we may transfer some or all Personal Data in our possession to another organization in the event of a merger, acquisition, bankruptcy, or other sale or transfer of all or a portion of our assets.

5. De-Identified and Aggregated Data

We may modify Personal Data, such as through de-identification or aggregation, to render the data no longer identifiable. We maintain and use this data only in its nonidentifiable form and do not attempt to re-identify the data.

6. Your Choices

If you have a registered account, you may update certain Personal Data in your profile or settings.

If you no longer wish to provide us information through our App, you may uninstall our App from your device. Note that this action will not delete your user account or any information we previously collected via the App nor does it affect our information collection on the Sites.

You may opt out of receiving promotional emails at any time via the unsubscribe link contained in the email message. This does not affect transactional communications or legal notices.

7. Personal Data About Minors

We collect Personal Data about minors under the age of 18. For example, parents and guardians may choose to provide us information about minors they care for. We conduct surveys that involve minors to support our educational and research programs. We also provide certain programs for minors such as a volunteer program. Additionally, certain portions of the Services are intended for direct use by minors, such as to provide educational information.

Where required by applicable law, we obtain consent before processing Personal Data about known minors. If you are a parent or guardian of a child under the age of 13, refer to the relevant parental consent form or notice provided to you, if applicable, for more information.

Note that as a nonprofit organization, certain children鈥檚 privacy laws, such as the Children鈥檚 Online Privacy Protection Act (COPPA), do not apply to us.

8. Privacy Rights: Delaware and New Jersey Residents

Certain Delaware and New Jersey state privacy laws provide Delaware and New Jersey residents specific rights related to the state resident鈥檚 Personal Data. These laws, including privacy rights, do not apply to residents that interact with us solely in a commercial or employment context, including healthcare providers, employees, and job applicants. Subject to legal requirements, privacy rights requests are subject to our identity verification process, which may include us asking for information about you for authentication purposes. Parents and guardians may submit a request on behalf of their children that are under 13 years of age.

If you are a Delaware or New Jersey resident, you may contact us at privacy@nemours.org to request:

  • Confirmation on whether we are processing your Personal Data
  • Access to, including a transportable, readily usable copy of, your Personal Data
  • Correction of your inaccurate Personal Data
  • Deletion of your Personal Data

Additionally, Delaware residents may request a list of the categories of third parties to which we have disclosed their Personal Data.

Under these laws, some of our practices, such as our disclosure of Personal Data through Cookies, may be considered 鈥渟ales鈥. We may also use Personal Data for the purposes of targeted advertising, including through Cookies. To opt out 鈥渟ales鈥 and/or targeted advertising, contact privacy@nemours.org.

If we do not grant your request, you may appeal our decision by contacting us at privacy@nemours.org.

9. Data Security

We use a variety of security technologies and procedures to help protect your Personal Data from unauthorized access, use, or disclosure. However, we cannot guarantee the security of your Personal Data transmitted through the Internet. Any transmission of Personal Data is at your own risk.

10. Links to Other Services

The Services may contain links to other websites, mobile applications, or other online services that we do not maintain or control. This Privacy Statement does not apply to online services that we do not maintain or control. You should carefully review the applicable privacy policies before using or engaging with any other online service.

11. Updates to This Privacy Statement

The 鈥渆ffective date鈥 at the top of this Privacy Statement indicates when this Privacy Statement was last updated. Any changes are effective when we post the updated Privacy Statement.
